Photo and video agreement

1. This agreement constitutes an order for wedding photography OR wedding photography and film. This includes the taking of wedding pictures OR wedding pictures with film as agreed to by both parties upon acceptance of the invoice/quote. The Studio (Caitlin Amy Photography ABN 46 100 463 429 ) and contacting party (client). The Studio refers to Caitlin Amy Photography, its employees, or subcontractors.
2A. A non refundable $1900 booking fee is required to reserve the clients date upon engaging the photo/video collection. This deposit is then deducted from the clients full balance and it NOT an additional fee .

3. The client warrants that the event details and personal details are correct.
4. If the client needs to cancel the agreement or change their reserved date at any time, the booking fee will be forfeited under any circumstance.
5. Upon cancellation, the booking fee is not transferable to another wedding date reservation, unless the Australian Government restrictions are the sole cause for the change of date.
6. If government restrictions force the client to postpone, they may postpone to a new MUTUALLY AGREEABLE date. If a mutually agreeable date cannot be found, the client forfeits their deposit.
7. The client may cancel the agreement more than 8 weeks prior to the wedding, in written notice to The Studio. In doing so, the client forfeits all monies paid to date, and in return the balance will be struck out by The Studio. If the client cancels within 4 weeks of the reserved wedding date, in written notice, the client is required to pay the balance to The Studio.
8. Should any delay or postponement of the event or alteration of event timetable occur, The Studio reserves the right to add such additional fees as necessary, especially if a contractor needs to be hired to accommodate.
9. The studio acknowledges that in taking the booking fee the client's wedding date shall be honoured. Your photographer/videographer will carry out his/her duties to the up most professional standard, however elements out of the studios control such as severe illness, physical condition or unforeseen tragedies, The Studio is not liable but will secure an appropriate replacement photographer/videographer. If a replacement photographer/videographer cannot be secured a refund of monies paid will be given.
10.The Studio will carry out this wedding assignment with all due professional diligence, and takes the upmost care when storing, transporting and processing your images, however there are elements beyond The Studio’s control including but not limited to: faulty materials, equipment failure, computer failure or loss or damage to digital negatives. Liability of the studio shall be limited to a refund of monies paid and will be the full and final satisfaction of any damage or loss incurred by the client.
11. The client shall make all arrangements and secure permissions of the proposed venues for use of photography by The Studio.
12. The Raw Files and footage remain the property of The Studio. High Resolution processed images and video will be given to the client under the discretion and judgment of The Studio. Under no circumstances does the client have access to Raw Files, footage or unprocessed work. The client will only receive the amount of images and length of film as per their selected package.
13. The clients images will be delivered via digital cloud gallery with an expiration time of 1 year. After this time, it is the responsibility of the client to ensure they have downloaded and stored their images for safe keeping.
14. Copyright of the images including concepts and artwork remain the property of the studio. The Studio reserves the right to use the material for future promotional and advertising purposes, always with taste and integrity.
15. The client agrees to pay the full balance two weeks prior to the wedding.
16. The studio has a 4-8 week turnaround for photos and 12 week turnaround for film to be received digitally. (This can be longer during peak times). The images will first be delivered via digital gallery and film delivered via vimeo.
17. If photographer(s) or videographers are attending the reception a meal is to be provided.
18.Photographing or photographing and filming the clients wedding day will be at the discretion of the studio. The studio will make every reasonable effort to comply with the clients requirements.
19. The Studio reserves the right to use it's artistic judgment in the final image product or image and film product and the selection of images/footage provided to the client with processing of colours, contrast, vibrance, white balance, tone curves, shadows, whites, blacks and exposure included.
20. Photoshop body manipulation or skin adjustments are not the responsibility of The Studio. If the client requests appearance or environmental manipulation of images, the client will be referred on to a retouch company with a cost of $10-$15 per image.
21. The client acknowledges that the photographer/s and videographers will work to the best of their ability through any scheduling and lighting restrictions that may be presented on the wedding day and the images or images/film received may reflect these restrictions.
22. Hair, make-up and clothing adjustments are not the responsibility of The Studio.
23. The client agrees not to alter the images or film received in any way. This includes Instagram filters or any form of editing.
24. It is the responsibility of the client to ensure that The Studio is a suitable service provider, which reflects the style of work that suits the clients needs and cultural background. Any special requests from the client must be indicated in writing to The Studio no later than the final contact before the wedding.
25. The client who purchases an album has two free rounds of revisions to the design before any additional changes are charged at $70/round. The client has 14 days from the presentation of the design to request any changes. Only one album design per album type is allowed. For example, if you order a parent album the design must be the same. If the client requests otherwise a fee of $200/ new design will be incurred. Albums must be ordered 6 months post wedding.
26. Any additional processing (colours, contrast, black and white, white balance etc) requested by the client after the wedding, will be charged at $10 per image. A flat fee of $80 for applies to each round of changes. The images will be delivered via online gallery, for download and can be printed up to 20”x30”. 23. THE RAW FILES/FOOTAGE WILL BE STORED FOR 1 YEAR POST WEDDING DATE. AFTER THIS DATE THE FILES WILL BE DISCARDED. IT IS THE RESPONSIBILITY OF THE CLIENT TO ENSURE THAT THE IMAGES RECEIVED ARE SECURELY DOWNLOADED, BACKED UP AND STORED.
Clauses exclusive to videography
AUDIO RECORDING
1. The client acknowledges that audio must be requested prior to the wedding and reflected as an additional add on to the photo/video collection.
2. In the event that audio is included; the studio use a lapel microphone attached to
the bride/groom during the ceremony to record audio of the
bride/groom. During the speeches the studio
record directly from the venue PA system where possible. If
the venue does not allow this the studio will use
alternate methods of recording. These alternate methods
may reduce the quality of audio.
Any person making a speech must use the microphone
to be able to record audio. The studio reserves
the right to omit any unacceptable audio recordings
where microphones are not used correctly or at all. It is
the responsibility of the MC to notify Design Patrol 10
minutes prior to any formalities starting during the reception
so that the studio has adequate time to set-up
equipment.
While the studio takes the utmost care in recording
audio from your ceremony and speeches, factors outside of
the studio’s control that can effect audio quality
can include but are not limited to: venue restrictions, weather
conditions, ambient noise and mobile phone/ frequency
interference.
MUSIC CHOICE
3. Relating to music choices, the studio will choose a song (based on the
clients selections) that is licensed for online use. The client
can share the Short Film online and on social media.
ADDITIONAL CHARGES
4. If something occurred at the event that the client does not
want to appear in the film, the client must instruct The studio before editing begins. Editing requests after the film has been delivered to the client will be billed at the
current rate of $95.00 per hour for editing and labour. Reediting
is available to the client for a period of (3) three days
after delivery of the film.
